This Affiliate Program Agreement (“Agreement”) governs participation in the Top Photo Awards Affiliate Program (“Affiliate Program”) operated by TopPhotoAwards.com (“TPA,” “we,” “us,” or “our”).
By joining the Affiliate Program, accessing your Affiliate account, using your personal Affiliate discount code or referral link, or otherwise participating in the Affiliate Program, you (“Affiliate,” “you,” or “your”) agree to the terms below.
1. Affiliate Program
The Top Photo Awards Affiliate Program allows approved Affiliates to promote TopPhotoAwards.com and earn commissions on qualifying purchases attributed to their Affiliate account.
Affiliates may promote TPA through their websites, social media accounts, blogs, newsletters, photography communities, videos, or other appropriate promotional channels.
Participation in the Affiliate Program does not create an employment relationship, partnership, joint venture, agency relationship, or franchise between TPA and the Affiliate. Affiliates participate as independent contractors.
2. Personal Affiliate Link and Discount Code
Each Affiliate will receive a unique personal Affiliate referral link and discount code (“Affiliate Code”).
The Affiliate link and Affiliate Code will be displayed in the Affiliate’s dashboard and may be shared with the Affiliate’s audience.
The Affiliate Code gives eligible customers the applicable discount when making a purchase on TopPhotoAwards.com.
The Affiliate Code itself does not track a referral and does not guarantee a commission. For a purchase to generate a commission, the customer must first visit TopPhotoAwards.com through the Affiliate’s personal referral link so that the referral can be recorded by TPA’s tracking system.
Affiliates are therefore encouraged to share their personal Affiliate link together with their discount code.
Affiliate Codes and referral links may not be sold, transferred, or assigned to another person without written permission from TPA.
3. Referral Tracking and 365-Day Cookie
When a visitor accesses TopPhotoAwards.com through an Affiliate’s personal referral link, TPA may store a referral cookie on the visitor’s device for up to 365 days.
If that visitor completes an eligible purchase during the applicable tracking period, the purchase may be attributed to the Affiliate and a commission may be generated.
Important Tracking Requirement
A customer using an Affiliate’s discount code does not, by itself, establish Affiliate attribution.
If a customer receives or discovers an Affiliate Code but visits TopPhotoAwards.com directly, without first using the Affiliate’s referral link, TPA is unable to reliably associate that customer with the Affiliate. In such cases, no Affiliate commission will be credited, even if the customer successfully uses the Affiliate’s discount code.
A referral may also not be tracked if the visitor:
- blocks or disables cookies;
- deletes the Affiliate cookie;
- uses a different browser or device;
- uses privacy or security software that prevents tracking; or
- otherwise prevents TPA’s tracking system from identifying the referral.
TPA cannot manually guarantee commissions for transactions that were not recorded by its Affiliate tracking system.
TPA’s internal tracking records will be used as the basis for determining referral attribution and commission eligibility.
4. Affiliate Dashboard
Approved Affiliates will have access to Affiliate information within their TPA profile.
The Affiliate dashboard will display:
- Conversions — the number of qualifying purchases attributed to the Affiliate.
- Total Sales — the total value of qualifying sales attributed to the Affiliate.
- Pending — commissions that have been recorded but are still within the required waiting period or awaiting approval.
- Paid — commissions that have already been paid to the Affiliate.
The Affiliate dashboard may also display the Affiliate’s personal referral link, Affiliate Code, commission rate, and other available statistics.
Affiliate statistics may not update immediately after a transaction. Transactions may remain pending while payments, refunds, cancellations, chargebacks, and other eligibility requirements are verified.
5. Commissions
Affiliates receive a commission on qualifying purchases successfully attributed to their Affiliate account through TPA’s Affiliate tracking system.
The applicable commission percentage or amount will be displayed in the Affiliate’s dashboard, Affiliate Program invitation, or other written communication from TPA.
Commissions are calculated based on the eligible purchase amount determined by TPA. Taxes, refunds, chargebacks, credits, discounts, fees, or other excluded amounts may not be commissionable.
The commission rate may vary by product, subscription, promotion, Affiliate, or campaign.
TPA reserves the right to change commission rates for future transactions. Updated commission rates will apply after the change becomes effective.
6. Qualifying Purchases
A purchase qualifies for an Affiliate commission only when:
- the customer was successfully tracked through the Affiliate’s personal referral link;
- the applicable Affiliate cookie or referral information was successfully recorded by TPA;
- the transaction was completed during the applicable 365-day tracking period;
- the transaction was successfully completed and paid;
- the transaction has not been canceled, refunded, reversed, disputed, or charged back; and
- the transaction otherwise complies with this Agreement.
Use of an Affiliate Code alone does not qualify a transaction for commission if the customer was not previously tracked through the Affiliate’s referral link.
Commissions generated through fraudulent, manipulated, unauthorized, self-referral, or artificial transactions are not eligible for payment.
7. Refunds, Cancellations and Chargebacks
If a customer receives a full or partial refund, cancels a qualifying purchase, initiates a chargeback, or the payment is otherwise reversed, the corresponding commission may be canceled, reduced, or deducted from the Affiliate’s commission balance.
If the applicable commission has already been paid, TPA may deduct the corresponding amount from future commissions owed to the Affiliate.
8. Pending Period and Affiliate Payments
Affiliate commissions are subject to a 30-day pending period following the latest qualifying order included in the payout.
This waiting period allows TPA to verify transactions and account for possible refunds, cancellations, payment disputes, chargebacks, or other adjustments.
The minimum payout amount is $10 USD.
Once the Affiliate has at least $10 in eligible commissions and the applicable 30-day pending period has passed, the commission becomes eligible for payout.
Affiliate payments are made through PayPal.
The Affiliate is responsible for providing a valid and accurate PayPal account or PayPal email address. TPA is not responsible for delays or failed payments caused by incorrect payment information provided by the Affiliate.
The Affiliate is responsible for any applicable taxes, reporting requirements, PayPal fees, currency conversion fees, or other obligations related to Affiliate earnings.
TPA may temporarily hold a payment while investigating suspected fraud, payment disputes, attribution issues, violations of this Agreement, or unusual Affiliate activity.
9. Promotion Requirements
Affiliates are encouraged to promote Top Photo Awards authentically and accurately.
Because Affiliate commissions depend on referral tracking, Affiliates should direct customers through their personal Affiliate link rather than sharing only their discount code.
Affiliates may use approved TPA names, logos, links, images, promotional materials, and Affiliate Codes solely for purposes of participating in the Affiliate Program.
Affiliates must not:
- make false or misleading statements about TPA;
- impersonate TPA or represent themselves as employees or official representatives of TPA;
- make guarantees regarding contest results, awards, exposure, earnings, or other outcomes;
- use spam, unsolicited bulk messaging, or deceptive advertising;
- engage in fraudulent clicks, fake referrals, artificial transactions, or other manipulation of the Affiliate Program;
- create accounts or transactions solely for the purpose of generating commissions;
- use TPA trademarks, brand names, or confusingly similar terms in domain names or social media usernames without permission;
- run paid advertisements using TPA brand terms or trademarks unless specifically authorized by TPA;
- promote TPA through illegal, defamatory, discriminatory, deceptive, or otherwise inappropriate content; or
- manipulate cookies, Affiliate links, discount codes, transactions, or attribution in an attempt to generate commissions.
TPA may reject or cancel commissions resulting from prohibited promotional activity.
10. Affiliate Disclosure
Affiliates are responsible for clearly disclosing their Affiliate relationship with TPA whenever required by applicable advertising, consumer protection, endorsement, or similar laws and regulations.
Where appropriate, Affiliates should clearly communicate that they may receive a commission when someone makes a purchase after using their Affiliate link.
11. Intellectual Property
TPA grants the Affiliate a limited, non-exclusive, non-transferable, revocable permission to use approved Top Photo Awards names, logos, links, and promotional materials solely for promoting TPA under this Affiliate Program.
All ownership rights in Top Photo Awards trademarks, branding, website content, designs, and other intellectual property remain with TPA or their respective owners.
Affiliates may not alter TPA branding in a misleading manner or create materials that could reasonably appear to be an official TPA website, account, advertisement, or communication unless authorized by TPA.
12. No Guaranteed Earnings
Participation in the Affiliate Program does not guarantee any minimum amount of referrals, sales, commissions, or income.
Affiliate earnings depend on qualifying purchases successfully tracked and attributed to the Affiliate according to this Agreement and TPA’s tracking system.
TPA does not guarantee that every person who receives or uses an Affiliate Code will be successfully tracked as an Affiliate referral.
13. Program Changes
TPA reserves the right to modify the Affiliate Program, including commission rates, customer discounts, tracking methods, cookie duration, eligible products, payout requirements, promotional rules, or other program features.
Material changes may be communicated through the TPA website, Affiliate profile, email, or other reasonable means.
Continued participation in the Affiliate Program after updated terms become effective constitutes acceptance of the updated terms.
14. Suspension and Termination
Either TPA or the Affiliate may terminate participation in the Affiliate Program.
TPA may immediately suspend or terminate an Affiliate account for fraud, abuse, misleading advertising, manipulation of referrals, violation of this Agreement, violation of TPA policies, or other conduct that may harm TPA, its users, sponsors, partners, or reputation.
Upon termination, the Affiliate must stop using TPA Affiliate promotional materials and representing themselves as a TPA Affiliate.
Legitimate approved commissions earned before termination may remain payable, subject to this Agreement. Fraudulent, prohibited, or otherwise ineligible commissions may be canceled.
15. Limitation of Liability
To the maximum extent permitted by applicable law, TPA will not be responsible for indirect, incidental, special, consequential, or lost-profit damages arising from participation in the Affiliate Program.
TPA does not guarantee uninterrupted or error-free operation of Affiliate tracking, cookies, referral links, dashboards, websites, payment systems, or other technical services.
16. Affiliate Responsibility
The Affiliate is responsible for their own promotional activities, content, accounts, websites, communications, taxes, expenses, and compliance with applicable laws.
Nothing in this Agreement authorizes the Affiliate to enter into agreements or make commitments on behalf of TPA.
17. Governing Terms
This Agreement operates together with the applicable Top Photo Awards Terms and Conditions, Privacy Policy, contest rules, and other policies published by TPA.
If a specific Affiliate campaign includes additional written terms, those terms will also apply to that campaign.
18. Acceptance
By applying to, joining, or continuing to participate in the Top Photo Awards Affiliate Program, the Affiliate confirms that they have read, understood, and agreed to this Affiliate Program Agreement.
